The first podcast of many to come. We cover how to deal with traffic stops and the coronavirus as well as how the 4th amendment works with regard to traffic stops. The questions presented in the podcast are as follows: 1. Can the driver of the vehicle provide consent for a search of… a. The Trunk? b. The Glove Box? c. The Passenger’s Pockets? d. The Passenger’s Backpack? 2. If the driver consents to the search of the Defendant’s backpack, can a law enforcement officer then legally search the backpack? 3. Did the Defendant have a legitimate expectation of privacy in the area searched? a. If yes, is that expectation of privacy one that society is prepared to recognize as reasonable? 4. In what ways can the Defendant show under the “Totality of the Circumstances” standard that he did indeed have a legitimate expectation of privacy in the area searched? 5. Lastly, did the warrantless search of the Defendant’s backpack violate his 4th Amendment right against unreasonable searches and seizures?
